{"id":2841,"date":"2011-11-14T19:04:39","date_gmt":"2011-11-15T03:04:39","guid":{"rendered":"http:\/\/daviddilworth.com\/pol\/?p=2841"},"modified":"2014-03-04T10:02:31","modified_gmt":"2014-03-04T18:02:31","slug":"pacific-grove-intends-to-violate-law-but-only-temporarily","status":"publish","type":"post","link":"https:\/\/daviddilworth.com\/pol\/pacific-grove-intends-to-violate-law-but-only-temporarily\/","title":{"rendered":"Pacific Grove Intends to Violate Law &#8220;But only Temporarily&#8221;"},"content":{"rendered":"<p><strong>This Wednesday the PG Council has an agenda item to approve extending business hours at the hotly contested <strong class='StrictlyAutoTagBold'>Golf Course Grill<\/strong> into the evening to accommodate non-golfers.<\/p>\n<p>Because of the traffic and noise impacts to the neighborhood the Council is required to complete <a href=\"http:\/\/1hope.org\/ceqa.htm\">CEQA <\/a>analysis before approving any such operation. In addition, because the land is zoned as <strong class='StrictlyAutoTagBold'>Open Space<\/strong> any use that is not golf course or recreation related is prohibited by city law.<div id=\"attachment_3539\" style=\"width: 420px\" class=\"wp-caption alignright\"><a href=\"http:\/\/daviddilworth.com\/pol\/wp-content\/uploads\/2012\/04\/Frutchey.jpg\"><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-3539\" src=\"http:\/\/daviddilworth.com\/pol\/wp-content\/uploads\/2012\/04\/Frutchey.jpg\" alt=\"Pacific Grove City Mangler Tom Frutchey\" width=\"410\" height=\"550\" class=\"size-full wp-image-3539\" srcset=\"https:\/\/daviddilworth.com\/pol\/wp-content\/uploads\/2012\/04\/Frutchey.jpg 410w, https:\/\/daviddilworth.com\/pol\/wp-content\/uploads\/2012\/04\/Frutchey-111x150.jpg 111w, https:\/\/daviddilworth.com\/pol\/wp-content\/uploads\/2012\/04\/Frutchey-223x300.jpg 223w\" sizes=\"auto, (max-width: 410px) 100vw, 410px\" \/><\/a><p id=\"caption-attachment-3539\" class=\"wp-caption-text\"><strong class='StrictlyAutoTagBold'>Pacific Grove<\/strong> City Manager Tom Frutchey<\/p><\/div><\/p>\n<p>However, even though the City attorney has explained this, city staff and a few Councilmembers don&#8217;t want to wait.<\/p>\n<p>According to the Herald &#8212; <a href=\"http:\/\/www.montereyherald.com\/local\/ci_19331364\">&#8220;Several issues requiring review under the state Environmental Quality Act (CEQA) must be dealt with, he said, and a draft report under the act requires 30 days for the public to comment on it.&#8221;<\/a><\/p>\n<p>So staff has prepared a way to approve what they want and effectively evade the law.<br \/>\n<!--more--><br \/>\nWhat they intend to do is adopt this for &#8220;only 120 days&#8221; without complying with the law. The problem for the public is that when the court overturns this illegal decision &#8211; it will take at least a year &#8211; which is long after the temporary law has expired.
